Must You Refinance With Your Current Lender? How to Shop Privately

No, you do not have to refinance with your current lender. A refinance is a new loan that pays off the old one, any licensed lender can make it, and the company you pay today has no right of first refusal and no veto. This guide explains the difference between your lender and your servicer, exactly when your servicer learns you are refinancing, what a retention offer proves, and how to compare outside offers privately.

Key takeaways

Do you have to refinance with your current lender?

No. A refinance replaces your existing mortgage with a new loan, and any licensed lender can make it. Your current servicer does not approve or review the new loan; its only role is to state your payoff amount and accept the funds.

The U.S. Department of Veterans Affairs says an Interest Rate Reduction Refinance Loan goes through a private bank, mortgage company, or credit union rather than through VA, and its IRRRL page adds: "Terms and fees may vary, so contact several lenders to check out your options."

What is the difference between your lender and your servicer?

Your mortgage lender is the company that originally loaned you the money; your mortgage servicer is the company that sends your statements, collects your payments, and manages any escrow account. The Consumer Financial Protection Bureau notes that a different company commonly takes over as servicer after closing.

Under Regulation X, the outgoing servicer must normally notify you at least 15 days before a servicing transfer, the incoming servicer must write within 15 days after, and for 60 days a payment sent on time to the old servicer cannot be treated as late.

Will your current lender know you are shopping a refinance?

Not from the shopping itself. Your servicer learns you are refinancing when a lender requests a written payoff statement, usually close to closing, or earlier if a credit pull creates a trigger lead that reaches it. Quotes based on ranges, with no credit pull, tell it nothing.

What about trigger leads?

A trigger lead is created when a lender pulls your credit for a mortgage and a credit bureau sells that inquiry. Since March 2026, federal law limits who can buy one, but your current originator or servicer remains a permitted recipient; see mortgage trigger leads and your privacy.

How does a payoff statement work?

A payoff statement is the servicer's written figure for the balance that pays your loan in full as of a specified date. Under Regulation Z, the Consumer Financial Protection Bureau requires a creditor, assignee, or servicer to send one after a written request from you or someone acting for you, and "in no case more than seven business days." The new lender's closing agent usually orders it a week or two before closing.

The federal deadlines that frame a refinance, at a glance:

Event Federal deadline Rule
Old servicer's notice before a transfer At least 15 days before Regulation X
New servicer's notice after a transfer Within 15 days after Regulation X
Payoff statement after a written request Seven business days Regulation Z
Cancelling a refinance after signing Three business days (same-creditor refinance: new money only) Regulation Z (right of rescission)

Does your current lender give you a better deal for loyalty?

Not automatically. A retention offer is one lender's price on one day, not a market test, until it sits next to competing quotes on the same terms.

In a February 2023 research brief, Freddie Mac found that average rate dispersion across lenders for similar borrowers was less than 20 basis points from 2010 through 2021 and about 50 basis points in October and November 2022. Applying with two lenders instead of one lowered the rate obtained by about 10 basis points on average in the earlier period and about 20 basis points in the first 11 months of 2022. Those are historical averages, not a result any one borrower can expect.

The Consumer Financial Protection Bureau's guidance is direct: "Your best bargaining chip is usually having Loan Estimates from other lenders in hand."

How do you compare a retention offer with outside quotes?

A like-for-like comparison holds everything constant except the lender: same day, same loan amount, same term, same lock period, same points. The rate, A.P.R., origination charges, and lender credits on each Loan Estimate are then directly comparable, as laid out in how to read a Loan Estimate. When to refinance covers the break-even arithmetic.

What can relationship pricing prove on a Loan Estimate?

Only what appears on the form. A waived fee, a reduced origination charge, or a lender credit shows on page 2 of the Loan Estimate; a promise to take care of you appears nowhere and is not pricing.

Can your current lender penalize you for refinancing elsewhere?

Only if your loan carries a prepayment penalty, which the Consumer Financial Protection Bureau's Regulation Z limits to certain fixed-rate qualified mortgages and to the first three years after closing; the caps are in how soon you can refinance after buying.

The penalty is a term of the loan you are paying off, so it applies whether your current lender or a new one makes the refinance; the holder of your current loan can waive it as part of a retention offer, and a waiver counts only in writing. Many conventional loans carry none, and page 1 of your Loan Estimate or Closing Disclosure says yes or no on the prepayment penalty line.

Which refinance programs let you use any approved lender?

All of them. A VA Interest Rate Reduction Refinance Loan can come from any lender that makes VA-backed loans, not necessarily the one that made your current loan; VA's three conditions concern the existing VA-backed loan and your occupancy, not which lender you use. An FHA Streamline refinance works the same way: a lender makes the loan and FHA insures it.

Do seasoning and net tangible benefit rules change with the lender?

No. Programs set their own waiting periods and benefit tests, and those travel with the loan, so the same test applies whether Lender A or Lender B makes the new loan; how soon you can refinance after buying lists each program's clock.

Can you cancel a refinance after signing?

For most refinances of your primary residence, yes. The right of rescission gives you three business days after signing to cancel; under the Consumer Financial Protection Bureau's Regulation Z, it covers most non-purchase money mortgages, such as refinances and home equity loans, but not purchase loans. One exception bears on this topic: a refinance by the same creditor that already holds your loan is exempt from rescission except to the extent it advances new money, so the three-day right applies in full when a different lender makes the new loan and only to any new amount when the same creditor does.

You notify the lender in writing; a call does not count. Business days include Saturdays but not Sundays or legal public holidays, and within 20 calendar days after the lender receives your notice, any money you paid must be returned.

How does HomeTurf's Beat My Rate auction keep a refinance private?

A Beat My Rate auction lets you post your existing rate or pre-approval anonymously, and N.M.L.S.-verified, state-licensed lenders bid to beat it for 12, 24, 36, or 48 hours, capped at 48 hours because mortgage rates change daily. The existing lender is never told. HomeTurf is a technology marketplace, not a lender or loan originator, and you stay anonymous while lenders bid.

Your servicer may learn about the refinance when the lender you chose pulls your credit, if a trigger lead reaches it, and otherwise when that lender's payoff request arrives; any rate lock happens afterward with that lender. See purchase vs. refinance auctions and pre-approval vs. Beat My Rate for the other auction types.

Frequently asked questions

Will my current lender match an outside refinance offer?

Sometimes, and the way to find out is to ask with a competing Loan Estimate in hand. The Consumer Financial Protection Bureau says lenders are often willing to match or beat competitors' offers. A verbal promise is not a match; revised terms count only on a new Loan Estimate compared on the same day and terms.

Does refinancing with the same lender skip the appraisal or closing costs?

Not automatically. A refinance is a new loan with its own application, Loan Estimate, and closing costs, whichever lender makes it, and whether an appraisal is required depends on the program and underwriting rather than loyalty. A current lender can waive or credit fees, and any reduction appears on page 2 of its Loan Estimate.

How do I get a payoff statement without tipping off my servicer?

You cannot; the servicer is the company that issues it. Under Regulation Z, your servicer must send one within seven business days of a written request from you or someone acting for you, such as your new lender's closing agent, unless the loan is in bankruptcy or foreclosure or another listed exception applies. What varies is timing: the closing agent usually orders it a week or two before closing, so the request reaches your servicer near the end of the process, not while you are comparing offers.

Can I refinance with a different lender if my loan was sold?

Yes. A loan sale or servicing transfer changes who owns the loan or collects the payments, not your right to pay it off with a new loan from any lender. Regulation X requires the transfer notice to state that the transfer does not affect any loan term other than those related to servicing.

Will refinancing elsewhere change who services my new loan?

It might, and so might refinancing with your current lender. Any lender can service the new loan or transfer servicing after closing. If so, Regulation X normally requires notice from the old servicer at least 15 days before the transfer and from the new one within 15 days after, and on-time payments to the old servicer are not late for 60 days.

Does my servicer have to release my loan when I refinance?

Yes. The servicer's role is to state the payoff amount and apply the funds, not to approve the new loan. Regulation Z requires the payoff statement to show the balance that would pay the obligation in full as of a specified date; once the closing agent sends that amount, the old loan is satisfied and its lien is released.
